Booking Policies
1. Introduction
Welcome to Modern Haus Media. By accessing our studio services or website, you agree to be bound by these Terms of Service. Please read them carefully to understand our photography engagement protocols and studio policies.
2. Booking & Deposits
A booking is officially secured once the required 50% non-refundable deposit has been received. By submitting payment, the client acknowledges and agrees to the booking policies listed on this website.
The remaining 50% balance is due before the session ends. The deposit will be applied toward the total session price.
Dates and times are not guaranteed until the required deposit has been received.
3. Cancelations & Rescheduling
The 50% deposit is non-refundable. If a client cancels within 48 hours of their scheduled session, all payments made toward the session will be forfeited.
Clients are encouraged to provide as much notice as possible when canceling.
Clients may reschedule their session at no additional charge when at least 48 hours' notice is provided. Rescheduling requests made within 48 hours of the scheduled session may be subject to a 10% rescheduling fee.
Rescheduling is subject to availability.
Exceptions may be made for circumstances such as illness, emergencies, or severe weather on a case-by-case basis.
4. Remaining Balance & Late Payments
The remaining 50% balance must be paid before the session ends.
Late payments may result in services being paused or delayed. A $10 per day late fee may apply to overdue balances unless otherwise stated.
5. Photo Delivery
Final edited photographs will generally be delivered within two weeks of the session.
Delivery times are estimates and may vary due to unforeseen circumstances, including illness, emergencies, technical difficulties, or other circumstances outside of Modern Haus Media's reasonable control.
6. Client Responsibility
Clients are responsible for providing accurate booking information and communicating any important requests or details before the session.
Clients are also responsible for obtaining any necessary permissions for locations, properties, or other individuals involved in the session.
Clients are expected to arrive on time and prepared for their scheduled session. Late arrival may reduce the amount of shooting time available and will not necessarily result in an extended session.
Legal
Editing & Final Images
Modern Haus Media maintains creative discretion over the final selection and editing of images. Standard editing includes adjustments such as exposure, color, contrast, cropping, and other adjustments necessary to create the intended final look.
RAW/unedited files are not included unless otherwise agreed upon.
Requests for extensive retouching or edits outside of the original service may require an additional fee.
Copyright & Image Usage
Modern Haus Media retains copyright and ownership of the original photographs and RAW files.
Clients receive permission to use their final delivered photographs for personal use, social media, printing, and other personal purposes.
Commercial use, resale, licensing, or other extended usage may require separate written permission.
Portfolio & Social Media Use
Unless otherwise requested and agreed upon, Modern Haus Media reserves the right to use photographs created during a session for its portfolio, website, social media, advertising, marketing, and promotional purposes.
Clients who do not want their images used publicly must communicate this request to Modern Haus Media.
No Guarantee of Specific Images
While Modern Haus Media will make reasonable efforts to accommodate requested poses, locations, and styles, specific photographs cannot be guaranteed.
Final results may vary based on lighting, weather, location, timing, subject cooperation, clothing, and other circumstances.
Force Majeure & Photographer Cancellation
Modern Haus Media reserves the right to reschedule a session due to severe weather, illness, emergencies, unsafe conditions, equipment issues, or other circumstances outside of reasonable control.
If Modern Haus Media must cancel and a mutually acceptable rescheduled date cannot be arranged, the client will receive a refund of payments made for the affected session.
Limitation of Liability
Modern Haus Media will take reasonable care when providing services and handling client files. However, Modern Haus Media is not responsible for circumstances outside of its reasonable control, including equipment failure, technical issues, data loss, platform outages, or other unforeseen circumstances.
Modern Haus Media does not guarantee specific personal, business, financial, social media, or marketing results.
Abandoned Bookings
If a client becomes unresponsive or fails to communicate regarding a scheduled booking, Modern Haus Media may consider the booking abandoned.
Payments already made, including the 50% deposit, will remain non-refundable.
Electronic Acceptance
By submitting a deposit or payment to Modern Haus Media, the client acknowledges that they have read, understood, and agreed to these Booking Policies and Legal Terms.
Payment of the required deposit serves as confirmation that the client accepts these policies.
